LANCASTER - Police in central Pennsylvania say they arrested an Amish man on drunk driving charges over the weekend after he was found asleep in his moving buggy.

East Lampeter Township Police say 22-year-old Elmer Stoltzfoos Fisher, of Paradise, was slumped over and asleep in a slow-moving buggy on Sunday night.

An off-duty officer from nearby Quarryville reported seeing the horse pulling the buggy at a walking pace as it straddled the center line.

Police say a breathalyzer test snowed Fisher's blood-alcohol content was 0.18, more than twice the 0.08 legal limit for drivers.

A good lawyer could get him off that BS ticket.  DUI laws are written for motor vehicles.  Of course, they could then get him for public endangerment.  Grin

Disagree totally...all vehicles using public roadways, including bicycles are subject to each States vehicle codes...typically, buggies are licensed and are required to have battery operated lights...

Probably nothing the government could do to him would compare with what kind if heLL he'll catch from his family...

We all know there's no such thing as a "hunted out" location.  Let's stop using that phrase to describe a park out of which you just dug a pile of coins!  Obviously that particular place wasn't "hunted out", right?

I agree with Stefen. All vehicles using public roadways are subject to the state laws including buggies. Laws in Pennsylvania are strictly implemented whether you're a local or foreign. Just recently, a ashington, Pa., male was recently busted two times in an evening for DUI. See it here: Two DUIs in one night for Pennsylvania man. The accused title is  Robert Brodnick. So it is a must, especially if you're new to the place, to know the basic rules and regulations.

Beaver County man faces drunken tractor ride charges

Yes DUI Is big Buisness in PA

it Keeps the Police,
Courts
Blood Labs,
Substance abuse clinics,
& Lawyers just to name a few
in the Black.

In many cases sitting or sleeping
in the drivers seat of a car,
walking out of a bar with keys in your hand
(I Know people who were arested for intent to dui),
Walking while Intoxicated,
Drinking on your front Porch,
Drinking in front of those who
don't want people drinking, (public Drinking & Intoxication)
& Having one too many are Illegal in PA.

You don't even need to be on a road in a car.

a Field, the woods, your Driveway work too

Fact ;

hold a open can of beer in your hand,
& Peddle this

 down the sidewalk
or on the street in a parade.

I'll be Shocked if you don't get a D.U.I.

Without DUI there would be alot of Layoffs
or other New laws to charge people with
like Driving while Talking or singing
and listening to the radio.

Three Levels of DUI Penalties

if I was sleeping in a car drunk --without the keys being in the cars igition * =-- I would say -- I realized  I had to too much drink to drive safely so I was "sleeping it off " until I was sober enough to drive  safely * - thus I had no "intent to drive drunk" , because I might hurt others or myself if I did so.-- and since I was within my my own "private vehicle" while sleeping it off  , I was not drunk in public .  --and since a person can not tell without bothering and awaking me wither I just sleeping or sleeping a few too many off , legally speaking  I was bothering no one.

the amish dude could say --the "horse was driving" and he was thus just a "passenger" -- that he had went to sleep to "sleep it off" and that the horse was tied up, but it pulled itself loose and since he was asleep he was unaware of it doing so, and thus  * --the horse "drove" himself unguided.

represent yer self -- on case like this * -- just say "no" to state appointed lawyers * -- who will plead you out "guilty" or put up no real defense in most cases.

if your "not guilty" you do not pay the court cost" either.

there is no law saying you can not sleep in your car. * -- if your sleeping your not driving * so not DWI --- if the keys are NOT in the cars ingition --there is no "intent to drive" * -you were not trying to drive -- you were simply sleeping off a few too many . so as to not endanger anyone by driving * -- and since you are in your "private vehicle" you were not "drunk in public".-- and since you were sleeping , you were not bothering anyone --you were not causing a public problem by bothering folks. --matter of fact , you were being "respondsible" by NOT DRIVING.  Wink icon_thumright

key to DWI ---is DRIVING WHILE INTOXICATED ( DWI) -- THERE IS NO PWI (PARKED WHILE INTOXICATED) OR SICWI (SLEEPING IN CAR WHILE INTOXICATED) SO LONG AS YOUR NOT DRIVING OR ATTEMPTING TO DRIVE  YOUR NOT ENDANGERING THE PUBLIC AT LARGE --SLEEPING OFF A HANG OVER IN A CAR ISN'T ILLEGAL -- SINCE YOUR IN A "PRIVATE CAR" --YOUR NOT --"DRUNK IN PUBLIC" --AND SINCE YOUR SLEEPING YOUR NOT BEING A PUBLIC BOTHER TO OTHERS EITHER. -- PLEAD YOUR OWN CASE IF BROUGHT UP ON THESE CHARGES. =--DO NOT SETTLE FOR A PUBLIC "NO CONTEST" DEFENDER TO SELL YOU DOWN THE RIVER.

There is a joke where an officer sees a guy stagger out of a bar and up to a car at the curb.  The guy
then tries to find the door lock with his key and has a hard time of it.  The officer watches him for a bit
then walks up and says, "Say mister, do you figgure on driving that car home?"

And the drunk answers,  " Shuretainly. offisher, I have to, because I'm too drunk to walk."

In the same format, the cop approaches the drunk, and while talking to him 15 other cars leave the bar parking lot. The cop asks him to take a roadside breath test which he passes with flying colours. The cops says what the hell is going on here.. The 'drunk' explains he was never drinking, he's just the designated decoy!

%years ago, A neighbor of mine that had alzhiemers, was picked up by the police 70 miles from home on his lawnmower.. They tracked him from gas station to gas station....

The guy in this vid, reminds me of the old CB days back in the 70's.. I think the code was:
I'm 10-8, 10-10, 10-23, but 10-6 for a 10-100 and a 10-200.. Roll Eyes
(if you were a 'goodbuddy' back then you know exactly what this means)
